Data protection

The purpose of this document is to provide adequate information and protection for the processing and protection of the personal data of natural persons who come into contact with ML Rent Ltd. in accordance with the provisions of Act CXII of 2011 on the Right to Information Self-Determination and Freedom of Information and REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL.

The purpose of this privacy statement is to set out the data protection and data management principles and the data protection and data management policy of ML Rent Ltd., in order to ensure that in all areas of the services provided by the contractor, all individuals can be assured that their rights are respected when their personal data are processed.

ML Rent Ltd. reserves the right to update this privacy policy at any time due to changes in legislation or other changes. Changes will take effect upon uploading the revised Privacy Notice.

Data subject: any person identified, directly or indirectly, on the basis of personal data, or

- identifiable natural person

Personal data: data which can be associated with the data subject, in particular the name, the identification mark and one or more factors specific to the physical, physiological, mental, economic, cultural or social identity of the data subject, and the conclusions which can be drawn from the data concerning the data subject.

Consent: a voluntary and explicit expression of the data subject's wishes, based on appropriate information, by which he or she gives his or her unambiguous consent to the processing of all or some of the personal data relating to him or her.

Objection: a statement by the data subject objecting to the processing of his or her personal data and requesting the cessation of the processing or the deletion of the processed data.

Data controller: the natural or legal person or unincorporated body which, alone or jointly with others, determines the purposes for which the data are to be processed, takes and implements decisions regarding the processing (including the means used) or has them implemented by a processor.

Data processing: any operation or set of operations which is performed upon data, regardless of the procedure used, in particular collection, recording, recording, organisation, storage, alteration, use, consultation, disclosure, transmission, alignment or combination, blocking, erasure and destruction. In addition, the prevention of further use of the data, the taking of photographs, audio or video recordings and the recording of physical characteristics that can be used to identify a person (e.g. fingerprints, palm prints, DNA samples, iris scans).

Data transfer: the making available of data to a specified third party.

Data erasure: rendering data unrecognisable in such a way that it is no longer possible to recover it.

Data destruction: the complete physical destruction of the data medium containing the data;

Data processing: the performance of technical tasks related to data processing operations, irrespective of the method and means used to perform the operations and the place of application, provided that the technical task is performed on the data;

Data processor: a natural or legal person or unincorporated body who or which processes data on the basis of a contract, including a contract concluded pursuant to a legal provision.

ML Rent Ltd. is committed to protecting the personal data of its customers and partners, and considers it of the utmost importance to respect the right of informational self-determination of its customers, therefore it handles personal data confidentially and takes all security, technical and organizational measures to guarantee the security of the data.

The Data Controller processes the data provided solely for the purposes of determining the content of the service requested by the Data Subjects, modifying, fulfilling, invoicing and enforcing claims or maintaining contact.

Please note that the processing for the above purposes will also be carried out only in the manner provided for by the applicable legislation, to the extent and for the duration necessary to achieve the purposes, and only with the personal data that are indispensable for the achievement of the purposes and are suitable for the purpose.

The data processing of ML Rent Kft. is based on voluntary consent, contractual or legal obligations.

- In case of request for a tender: name / company name, telephone number, address or registered office, e-mail address.

- In case of contracting: in addition to the above, place and date of birth, name of the customer's mother, driving licence number, identity card or passport number.

ML Rent Kft. informs the subscribers of its newsletter about its news and special offers by means of commercial enquiries. ML Rent Kft. may contact subscribers by e-mail at the e-mail address provided by the client on its website.

The Data Controller shall process personal data until the customer relationship is established in the case of a request for a quotation, in the case of a contract until the deadline for the performance, settlement and payment of the service ordered by the Data Subject and the submission of the related warranty claim, the closure of the claim submitted, and the enforcement of other civil law claims. Data processing does not apply to data processing required by law (e.g. accounting regulations [Act CL of 2017 on the Rules of Taxation, Section 78 (3)]), which the Data Controller shall retain for the period specified by law.

The managing director of ML Rent Ltd. and the employees of the company whose job description includes data processing activities, subject to the signature of a confidentiality statement.

The Data Subject is aware that if the transfer of his or her personal data by the data controller is necessary for the performance of a contractual obligation, e.g. to an energy supplier, the data controller shall provide for the transfer in a separate declaration.

The Data Controller shall not be liable for the accuracy of the personal data provided by the Data Subject, for which the Data Subject shall be solely responsible.

The data subject may at any time request information about the data processed by the Data Controller, including the scope of the data processed, the time and method of data recording, as well as the principles and rules in force regarding data processing.

The data subject shall have the right to obtain, at his or her request and without undue delay, the rectification of inaccurate personal data relating to him or her. Having regard to the purposes of the processing, the data subject shall have the right to obtain the rectification of incomplete personal data.

In the case of a person acting on behalf of another person, it is his or her responsibility to obtain the consent of the Data Subject to disclose his or her data. The prior consent of the legal representative is required for the declaration of incapacitated persons and persons with reduced capacity to act.

At the request of the data subject, the controller shall provide information about the data of the data subject processed by the controller or by a processor to whom the controller or the processor has delegated the processing, the purpose, legal basis and duration of the processing, the name and address of the processor and the activities of the processor in relation to the processing, the circumstances of the personal data breach, its effects and the measures taken to remedy it, and, in the case of the transfer of personal data of the data subject, the legal basis and the recipient of the transfer.

The Data Controller is obliged to provide the information in writing within the shortest possible period of time from the submission of the request, but not later than 30 days, upon the Data Subject's request. If the Data Subject's request is refused, to provide a reasoned reply

The data subject may object to the processing of his or her personal data on the basis of the Info.

a) the processing or transfer of personal data is necessary for the fulfilment of a legal obligation to which the Data Controller is subject or for the purposes of the legitimate interests pursued by the Data Controller, the data subject or a third party, unless the processing is required by law;

b) the personal data are used or disclosed for direct marketing, public opinion polling or scientific research purposes                              ;

c) in other cases specified by law.

The Data Controller shall examine the objection within the shortest possible time from the date of the request, but not later than 15 days, decide whether the objection is justified and inform the applicant of its decision. If the Controller finds that the data subject's objection is justified, the Controller shall terminate the processing, including further collection and further transmission, and block the data, and shall notify the objection and the action taken on the basis of the objection to all those to whom the personal data concerned by the objection have been previously disclosed and who are obliged to take measures to enforce the right to object.

ML Rent Ltd. selects and operates the IT tools used to process personal data in the course of providing the service in such a way that the data processed:

accessible only to authorised persons; authenticated and authenticated; protected against unauthorised access.

ML Rent Ltd. takes appropriate measures to protect the data, in particular against unauthorised access, alteration, transmission, disclosure, deletion or destruction, as well as against accidental destruction, damage and loss of access due to changes in the technology used.

If the Data Subject has provided third party data in the course of the communication of the data for the use of the service and has caused damage in any way, the Data Controller is entitled to claim damages from the Data Subject. In such a case, the Data Controller shall provide all reasonable assistance to the competent authorities in order to establish the identity of the offending person.

We do not verify the personal data you provide to us. The person providing the data is solely responsible for the correctness of the data. By providing an e-mail address, any data subject is also responsible for ensuring that he or she is the only person using the e-mail address provided.

We inform our customers that the investigating authority, the National Authority for Data Protection and Freedom of Information, or other bodies authorised by law may contact ML Rent Kft. for information, disclosure, transfer of data or provision of documents.

The Data Controller shall ensure the security of the data, and shall take technical measures to ensure that the data recorded, stored or processed are protected, and shall take all necessary steps to prevent their destruction, unauthorised use or unauthorised alteration. It also undertakes to require any third party to whom it may transfer or disclose the data to fulfil its obligations in this respect.

When processing the data, the Data Controller shall act with the utmost care and in full compliance with the law, shall treat them confidentially and shall not disclose them to third parties, unless this is necessary to enforce its rights and obligations arising from the contract or the disclosure of the data to public authorities is required by law or a final decision of a public authority or court.
